Paul Hastings Secures Victory on Behalf of Invensys

New York, NY (July 12, 2010) Paul, Hastings, Janofsky & Walker LLP, a leading global law firm, announced today that the firm won summary judgment on behalf of its client Invensys plc in a long-fought litigation in the Southern District of New York.
The dispute arose out of the sale of Invensys' packaging business to Owens-Illinois, Inc in 1998 for approximately $3.6 billion. In 2005, Owens-Illinois filed suit against Invensys claiming losses in connection with three patent infringement lawsuits that were filed after the sale had taken place. Owens-Illinois claimed that Invensys had breached representations and warranties contained in the sales contract and that Invensys was obligated to indemnify Owens-Illinois for all of the losses stemming from the patent infringement lawsuits.
After extensive discovery, the Paul Hastings team moved for summary judgment on behalf of Invensys, arguing that the patent infringement lawsuits related to Owens-Illinois' changes to the business after the sale, not to any conduct by Invensys. Following oral argument, the court granted Invensys' motion, dismissed the case in its entirety and awarded Invensys its costs.
