FCC Rules Governing Local Telephone Networks Expire: Competitive Carriers, Industry Associations Will Seek Supreme Court Review

On June 14, 2004, the U.S. Supreme Court declined to hear requests by AT&T, MCI, and the National Association of Regulatory Utility Commissioners to stay the mandates issued by the U.S. Court of Appeals for the District of Columbia Circuit’s March 2, 2004 decision in United States Telecom Association v. Federal Communications Commission. The Supreme Court’s denial of the requests followed U.S. Solicitor General Theodore Olson’s June 9, 2004 announcement that his office would not seek an appeal of that decision.
