FCC Do Not Call Proceeding and Recent Litigation Under the Telephone Consumer Protection Act of 1991

In an October 2002 Client Alert, we reported that on September 18, 2002, the Federal Communications Commission released a Notice of Proposed Rulemaking seeking comment on possible revisions to its rules in order to carry out more effectively the directives in the Telephone Consumer Protection Act of 1991. One goal of the TCPA was to address the increasing number of telemarketing calls and not yet issued final rules in this proceeding; however, certain developments in this area have occurred recently.
