Overview

Evan Preminger is Of Counsel in the Environmental Litigation practice of Paul Hastings and is based in the firm's New York office. His practice focuses on environmental enforcement defense, regulatory compliance counseling, permitting and crisis response.

Evan has represented clients in litigation and summary proceedings on matters arising under both state and federal environmental laws, including the Comprehensive Environmental Response, the Compensation and Liability Act, the Resource Conservation Recovery Act, the Clean Water Act, and the New York State Environmental Quality Review Act. He has also advised clients in regulatory enforcement investigations and administrative debarment proceedings before both federal and state environmental agencies.

Evan has also advised clients in connection with the remediation and redevelopment of contaminated sites, as well as environmental support for real estate, corporate, renewable energy, and mineral rights transactions. He has considerable experience in permitting and environmental review for large scale infrastructure projects. He has further represented clients in connection with New York City land use approvals, including ULURP and the Landmarks Preservation Commission.

Previously, Evan served as the Assistant Secretary for the Environment for the New York State Executive Chamber, where he helped oversee operations and policy development for New York State's environmental and parks agencies.

Representations

  • Successfully represented an elder care facility developer in New York state litigation before the Appellate Division and Court of Appeals by challenging the sufficiency of the environmental review for a proposed Manhattan development.
  • Advised the project developer on the environmental review and permitting equivalency process for a $1.5 billion multipurpose arena project.
  • Advised regional transportation agency on environmental review and permitting equivalency process for a $2.5 billion rail expansion project.
  • Successfully represented developers in litigation supporting the sufficiency of New York City Uniform Land Use Review for the Gowanus Neighborhood rezoning project.
  • On behalf of a residential multifamily developer, successfully defended the sufficiency of the New York City Landmarks' approval for a 157-unit development in a Historic Preservation district.
  • Advised residential developers on regulatory approvals and remediation efforts under the New York State Brownfield Cleanup Program.
