Paul Hastings Named American Lawyer ‘Litigator of the Week’ Runner-Up for BioNTech Win in COVID Vaccine Patent Case

A Paul Hastings IP practice team earned runner-up in The American Lawyer’s “Litigator of the Week” recognitions for securing a victory for client BioNTech. The team convinced a panel of Patent Trial and Appeal Board (PTAB) judges to invalidate two Moderna patents asserted to cover its Spikevax COVID-19 vaccine that the company accused BioNTech and Pfizer of infringing. The judges found that the challenged claims of Moderna’s patents were obvious in light of previously published research and patent applications involving mRNA technology.
Global co-chairs of the Intellectual Property practice Naveen Modi, Eric Dittmann and Bruce Wexler led the Paul Hastings team, which also included partner Ashley Mays-Williams, of counsel Chetan Bansal and associate Ryan Meuth.
