Paul Hastings Represents Pro Bono Client Carlos Martinez Gutierrez in Supreme Court Deportation Case

January 17, 2012

San Francisco, CA (January 17, 2012) - Paul Hastings LLP, a leading global law firm, announced today that the firm is representing client Carlos Martinez Gutierrez on a pro bono basis in Holder v. Gutierrez, a case before the Supreme Court from the San Francisco-based 9th U.S. Circuit Court of Appeals. The Supreme Court will decide whether Mr. Martinez Gutierrez, who came to the United States as a child, can use the length of his father's lawful permanent residence to become eligible for relief from removal from the country under federal immigration laws.

The Supreme Court's decision in this case will have important implications for certain immigrants who have long-standing ties to this country but who have faced delays in achieving lawful permanent resident status.

Paul Hastings partner Stephen Kinnaird, who will argue the case, says, "This case raises the important issue of whether the immigration authorities should construe ambiguous statutory language in light of important federal immigration policy goals of promoting family unity and preventing undue hardship, rather than construing the statute to have harsh results that do not serve any federal policy purpose."

The Paul Hastings team is lead by partner Stephen Kinnaird with the assistance of Paul Hastings lawyers Igor Timofeyev, Tamara Graham, Maria Davis, Scott Carlton, Michelle Yetter, and Devon Winkles, as well as co-counsel Stephanos Bibas of the University of Pennsylvania Law School Supreme Court Clinic and Dario Aguirre and Michael Franquinha of the Aguirre Law Group LLP.
