SEC Chairman Seeks Emergency Rules for Hedge Funds

On July 25, 2006, in testimony at a hearing on the operation and regulation of hedge funds chaired by the Senate Committee on Banking, Housing and Urban Affairs, SEC Chairman Christopher Cox presented his views on the appropriate regulation of hedge funds. His testimony provides insight into how the SEC will seek to regulate hedge fund advisers after Goldstein v. SEC, the decision handed down last month vacating the SEC’s hedge fund adviser registration rules under the Investment Advisers Act of 1940.
