Partial Amendment of the Japan Patent Law

1. Introduction
On December 26, 2008, the Japanese Government issued a Cabinet Order to put the Law Partially Amending the Patent Law and other IP-related Acts (Law No. 16 of 2008) (The Amended Patent Law or Amendment) into effect as of April 1, 2009.
Of particular interest in this amendment is the establishment of a registration system for provisional licenses at the stage where the patent application is filed but the patent is not yet issued, and the limitations on disclosure of the registered information. This alert aims to provide a background of the amendment and an overview of the effects of the new registration system.
