Eddie Law & Steffi Tam
The Code of Practice on Consumer Credit Data, which was issued in 1998 by the Privacy Commissioner for Personal Data of Hong Kong pursuant to the Personal Data Ordinance, was first revised in March 2002. A breach of the Code by a data user (basically a person who controls the collection, holding, processing or use of personal data) in Hong Kong will give rise to a presumption against the data user in any legal proceedings under the Ordinance.
