Michelle Cohen and Kathrine Calderazzi
The Telephone Consumer Protection Act, and the Federal Communications Commission’s rules and orders implementing the TCPA, prohibit the sending of unsolicited commercial facsimile advertisements. The FCC has been vigilant in its enforcement of this “junk fax” prohibition. To date, the Commission has issued approximately 70 citations for possible violations of the TCPA, including citations to fax broadcasters, and has imposed forfeitures in excess of $1.5 million.
