An Overview of Japans New Soil Contamination Control Law: Has Superfund Come to Japan?

Set forth below is an outline of Japan’s new Soil Contamination Control Law, that was proclaimed on May 29, 2002 and will be effective on February 15, 2003. Prior to the enactment of the Law, Japan had no national law regulating soil contamination except that governing land for agricultural use. With the Law’s enactment, there has been a significant increase in the level of sensitivity to potential environmental liability within the Japanese real estate industry and the financial community.
