Wind Resistant: Environmental liability risks persist despite change in administration

Environmentalism is so deeply embedded into the U.S. culture — including its business culture — that even a radical change in U.S. presidential administrations won’t set it off course. Some good business practice that commercial real estate professionals have adopted are susceptible to the political winds. However, several signifi cant trends in the purchase and sale of commercial real estate will be largely unaffected by political change. These trends include the many sources of environmental liability, the utility of environmental insurance, the risk of criminal liability, after bankruptcy liability, and the movement toward disclosure and transparency.
