Complex Litigation and Arbitration Partner Oliver Browne co-authored an article published by the Oxford University Press publication, Arbitration International, titled ‘Which law should govern the ‘arbitrability’ of a dispute in England?’.
The article considers, from an English law perspective, the challenging question of the proper law to govern the arbitrability of a dispute, analysing this query in light of the decision of the Singapore Court of Appeal in Anupam Mittal v Westbridge Ventures II Investment Holdings, the only authoritative treatment of the relevant issues by a common law jurisdiction.
