eDiscovery and Disclosure – Italy

Only the USA and a few other countries have adapted their legal systems to address the discovery or disclosure of electronically stored information (ESI) by introducing specific rules and procedures for its production as well as protection of relevant privileged information.

The Italian legal framework does not provide for specific rules or procedures relating to the discovery and disclosure of ESI, and most of the new technological tools are little known in Italy.
