Strengthening Your China Compliance Program Through Employment Building Blocks: From Onboarding to Termination

Friday, July 29 04:00 AM BST to 04:00 AM BST

The International Anticorruption Law Committee and the China Committee are delighted to co-sponsor a breakfast program in Shanghai where Lesli Ligorner, partner at Paul Hastings and among the leading employment law specialists focusing on the Asia Pacific region, is the featured speaker. Based in Shanghai, and with extensive Japan experience, Ms. Ligorner draws on her knowledge of US law and practice, as well as the employment law regimes of China, Japan and other Asian markets to advise her clients on their cutting-edge concerns in the employment relations aspects of their businesses.

As FCPA enforcement has surged, Ms. Ligorner has increasingly been called upon to support companies' antibribery compliance aims. Given China's stringent regulation of employment relations and the limited grounds for termination it offers, this can indeed be a challenge. Topics to be discussed:

• Evaluating the risks in M&A due diligence• Implementing corporate employment/HR policies during onboarding or integration• Establishing internal complaint mechanisms in light of Dodd-Frank• Conducting effective investigations and collecting effective and sufficient evidence• Evaluating what disciplinary actions to take based on risk levels and company tolerance, with a focus on grounds for termination and handling settlement in light of US government views on same

The program will be moderated by Amy Sommers, Vice Chair of the International Anticorruption Law Committee and a former Chair of the China Committee. Ms. Sommers is a leading China compliance lawyer, whose expertise in the FCPA/antibribery compliance field has made her a sought after speaker, writer and advisor on the challenging issues associated with synthesizing compliance requirements and business imperatives in China's fast-moving market.
