Overview

Eric Lin is an associate in the Intellectual Property practice of Paul Hastings and is based in the firm’s New York office.

Mr. Lin has extensive experience representing clients ranging from startup companies to large multinational companies in high-stakes intellectual property and technology-related litigation involving patent infringement, trade secret misappropriation, and complex commercial claims in federal courts, in private arbitration, and before the U.S. International Trade Commission (ITC) and the U.S. Patent and Trademark Office (PTO). His matters have involved a broad range of technologies, including semiconductors, speech recognition, network security, antibodies, RNAi, medical devices, video podcasting, audio, advertising, digital cameras, fiber optics, electronic exchanges, food science, and packaging. 

In his pro bono practice, he has litigated civil rights claims, including violations of the U.S. Constitution, Americans with Disabilities Act (ADA), and Rehabilitation Act of 1973 (Rehab Act).

Mr. Lin’s practice has also extended beyond litigation. He has significant experience preparing and prosecuting utility and design patent applications. He has also counseled clients and conducted substantial due diligence on potential acquisitions, licenses, and technology transfers.

Mr. Lin is a member of the National Asian Pacific American Bar Association and Asian American Bar Association of New York and has spoken on or moderated panels regarding various topics, including the representation of Asian-based companies in U.S. litigations, design patents, and entrepreneurship. He is proficient in Mandarin Chinese and has been an invited speaker regarding certain patent issues at academic institutions in the U.S. and Taiwan.

  • Confidential Arbitration (JAMS). Representing CTO and current employer against former employer and competitor in employee mobility case involving complex commercial claims related to semiconductor test technology.
  • Finjan LLC v. Palo Alto Networks, Inc. (N.D. Cal.). Represented Palo Alto Networks in a multi-patent infringement case relating to network security technology.
  • Everlight Electronics Co., Ltd. v. Amazon.com, Inc. et al. (W.D. Tex.). Represented Amazon in a patent infringement case relating to LEDs.
  • ClearDoc, Inc. d/b/a OpenReel v. RiversideFM, Inc. (D. Del.). Represented RiversideFM in a patent infringement case relating to video podcasting. The judge dismissed the complaint with prejudice based on Section 101, and dismissed the motion for preliminary injunction as moot.
  • Guvera IP Pty Ltd. v. Spotify, Inc. (S.D.N.Y.). Represented Spotify in a patent infringement case relating to advertising. The judge dismissed the complaint with prejudice based on Section 101.
  • Certain Integrated Circuits, Chipsets, and Electronic Devices, and Products Containing the Same (ITC). Represented Amazon in an investigation alleging infringement of patents relating to integrated circuit design and packaging, and WiFi-6 technologies.
  • Nasdaq, Inc. et al. v. IEX Group, Inc. et al. (D.N.J.). Represented IEX in a multi-patent infringement case relating to electronic trading technology.
  • Certain High-Density Fiber Optic Equipment and Components Thereof (ITC). Represented Leviton in an investigation alleging infringement of patents relating to fiber- optic equipment technology.
  • Certain Filament Light-Emitting Diodes and Products Containing Same (ITC). Represented Amazon in an investigation alleging infringement of patents relating to LED packaging technology.
  • Certain Semiconductor Devices, Integrated Circuits, and Consumer Products Containing the Same (ITC). Represented TSMC in an investigation alleging infringement of patents relating to semiconductor manufacturing and design technologies.
  • Certain Carburetors and Products Containing Such Carburetors (ITC). Represented Amazon in an investigation alleging infringement of patents relating to carburetor technology. The Administrative Law Judge granted summary determination to Amazon (and other Respondents) for failure of Complainant to satisfy the domestic industry requirement, which the Commission affirmed.
  • Carl Zeiss AG and ASML Netherlands, B.V. v. Nikon Corp. et al. (C.D. Cal.). Represented Nikon in a patent infringement case relating to digital camera technologies. The jury returned a verdict in favor of Nikon, finding none of the asserted patents infringed. The case settled after trial on favorable terms.
  • Certain Digital Cameras, Software, and Components Thereof (ITC). Represented Nikon in an investigation alleging infringement of patents relating to digital camera technologies. The case settled after trial on favorable terms.
  • ScentSational Technologies LLC v. PepsiCo, Inc. et al. Represented PepsiCo in a trade- secret misappropriation, breach of contract, and correction of patent inventorship case relating to food science and packaging. The Court granted summary judgment to PepsiCo, which the Federal Circuit affirmed.
