Overview
Eric Lancaster is a partner in the Intellectual Property practice at Paul Hastings and is based in the firm’s Palo Alto office. He represents technology and pharmaceutical companies in all aspects of their lifecycle. Mr. Lancaster’s practice focuses on litigation matters across the country in district courts, the International Trade Commission, Patent Trial and Appeal Board and state courts.
His litigation experience covers intellectual property and antitrust matters spanning a variety of sectors and technologies, including pharmaceuticals, medical devices, software, social networking, mobile devices, semiconductors, LCDs and computer hardware. Mr. Lancaster has served as lead counsel for his clients in multiple litigation matters.
In addition to his litigation work, Mr. Lancaster provides strategic and commercial advice to leading multinational companies and has significant experience with IP and commercial due diligence investigations in the context of analyzing complex commercial and technology-related aspects of corporate transactions.
Mr. Lancaster is committed to helping grow and develop the next generation of leaders and giving back to his community. Mr. Lancaster is an adjunct professor at Berkeley Law School, where he teaches Antitrust and Innovation. He also serves in a leadership role on the Silicon Valley Urban Debate League's Legal Advisory Committee, which partners with the Silicon Valley Urban Debate League (SVUDL) to help youths from low-income backgrounds tap the power of their voices to compete, excel and change the world through the rigor and thrill of the academic sport of debate.

- Obtained a jury verdict of validity and infringement, followed by a permanent injunction on behalf of a plaintiff in the District of Delaware.
- Lead patent team representing a global pharmaceutical company defending against "reverse payment" antitrust claims.
- Represented a major pharmaceutical company in multiple BPCIA matters.
- Representing a multinational retail corporation’s global eCommerce division in various patent litigation matters throughout the United States.
- Represented Anthem in its defense against the US Department of Justice's lawsuit to block Anthem's $54.2 billion agreement to acquire Cigna Corporation, the largest merger ever in the health insurance industry.
- Represented a leading global technology company in multiple recent acquisitions of technology companies.
- Represented a smart home company in a patent infringement case brought by Allure Energy.
- Represented DreamWorks, Sony Pictures Imageworks, Deluxe Entertainment, and Hydraulx in patent litigation involving computer graphics software.
- Obtained summary judgment of invalidity of all asserted claims of both patents on behalf of a multinational technology company after all other defendants settled in patent litigation involving social networking systems, as well as award of all requested costs.
- Obtained complete defense jury verdict of non-infringement and invalidity for a multinational software corporation in a patent infringement suit involving CAD software.
- Obtained Final Determination of non-infringement or invalidity of all five asserted patents on behalf of Respondents Chimei InnoLux, InnoLux, and Chi Mei Optoelectronics USA in Section 337 Investigation involving LCD products. The Federal Circuit upheld the Commission's Final Determination providing a complete victory for our clients.
- Representing a multinational technology company in association with Nokia's allegations targeting the company’s virtual assistant software application in the ITC.
- Lead counsel defending a data infrastructure technology company against Monterey's allegations of patent infringement in the US District Courts for the District of Delaware and Northern District of California.
