Overview
Simon Hui is a partner in the Litigation Department of Paul Hastings.
Simon’s practice focuses on compliance investigations, white collar defense as well as international arbitration. He has more than 25 years practice experience in handling complex investigations, data compliance, and cross-border arbitration cases. He has represented top tier international and domestic companies before government regulators and in arbitration cases before CIETAC, HKIAC, and SHIAC. Simon is an arbitrator of the Shanghai Arbitration Commission and Shenzhen Court of International Arbitration.
Simon is consistently recognized as the "Tier 1 Leading Individual" in the field of Regulatory & Compliance and Dispute Resolution in China by Legal 500 and the "Leading Individual" in Corporate Investigations/Anti-Corruption by Chambers Greater China. Investigations and Enforcement
- A major multinational life science company in a large-scale anti-bribery/corruption internal investigation in respect of its business activities in China. Conducted interviews with employees, reviewed evidence, and provide recommendations.
- A leading U.S.-based pharmaceutical company in an internal investigation covering a wide range of allegations against the target, including conflict of interests, receiving kickbacks from distributors, falsifying high-value services contracts, and misappropriating company assets.
- A global consumer electronic appliance manufacturer to conduct a full-scale investigation against allegations including sales data manipulation, embezzlement, and bribery/corruption. The investigation covered the company's China leadership and sales team as well as its entire sales network of more than 800 retail outlets across the country.
Compliance and Risk Assessment
- A world-leading motor company in relation to major investment projects ranging from acquisition of a major state-owned car company and a top-tier battery manufacturer to securing mining rights in developing Asia. He led the team to develop an effective compliance management program for the client.
International Arbitration and Dispute Resolution
- A U.S.-based aircraft leasing company to repossess an aircraft against a delinquent Chinese freight carrier. Assisted the U.S. leasing company to participate in a bankruptcy proceeding in the PRC to recover the outstanding rental hire and repossession costs and expenses.
- A leading international certification company before CIETAC in a dispute concerning the acquisition of a leading project management company in Shanghai. The dispute involves complex issues including financial determination of pre-acquisition profits.
- A leading technology company on issues relating to a HKIAC arbitration proceeding regarding dispute arising out of a note purchase agreement, note and guaranty agreement. The matter involves complex issues arising under the law of guarantees and indemnities as well as complex multi-party and multi-contract issues.
