Overview

Peter Montoni is a partner in the Financial Restructuring group at Paul Hastings and is based in the firm’s New York office. Peter specializes in debt restructuring and workouts. He advises senior management and deal team members in all aspects of financing transactions, including structuring, documenting, negotiating and restructuring asset-based loans, asset-backed loans, cash flow loans, and structured financing products across a variety of business sectors, including manufacturing, media, retail, and service industries.

Peter counsels deal teams on the largest and most complicated restructuring matters. Most recently, he has served in key roles in many of the New York finance and restructuring group's Chapter 11 representations, including representing Antares Capital LP (and a group of lenders) in the Shoes for Crews bankruptcy proceeding in their respective capacities as prepetition lenders, DIP lenders and 363 credit bid purchaser of the assets, MacQuarie Capital (USA) LLC in the Heritage Power LLC Chapter 11 Bankruptcy as prepetition project Letter of credit issuer and lender and KKR in Sequential Brands Group as DIP lender, Term B lender and lender to the 363 asset purchaser in connection with the Sequential Brands Group, Inc. Chapter 11 bankruptcy proceedings, involving over $470 million of debt.

In addition, Peter represents leading private credit funds, special situations and opportunistic funds, BDCs, banks, hedge funds and other investment advisors in all aspects of financial restructurings, including out-of-court workouts and Chapter 11 bankruptcies. Peter regularly counsels clients in connection with structuring issues for new transactions and on intercreditor agreements, subordination agreements, and agreements among lenders.

Prior to joining Paul Hastings, Peter spent over a decade as an in-house finance and restructuring attorney, first at General Electric Capital Corporation and thereafter at Antares Capital. At both institutions, Peter provided legal oversight for a multibillion-dollar portfolio of lending commitments.
