Client Successes
Won a critical victory for GlaxoSmithKline (GSK), and the entire pharmaceutical industry, in a legal battle before the U.S. Supreme Court. The plaintiffs challenged the exempt status of GSK’s workforce of several thousand current and former pharmaceutical sales representatives. The stakes were enormous, with billions of dollars in potential damages and the industry’s decades-old sales structure hanging in the balance.
Represented UBS AG in a lawsuit accusing negligent misrepresentation, breach of contract, and fraud. We obtained a unanimous dismissal by New York’s First Department of all fraud claims and affirmation of the dismissal of negligent misrepresentation and punitive damage claims. This decision has been widely cited as authority on New York law regarding complex transactions between sophisticated counterparties.
Represented Kolon Industries, Inc. in a landmark decision before the U.S. Court of Appeals for the Fourth Circuit reversing a district court opinion on market definition. In Kolon’s antitrust counterclaim the district court had dismissed the counterclaim holding that Kolon had not adequately pleaded its claim due to not including all locations where the product suppliers are headquartered. The Fourth Circuit reversed the decision in this significant ruling.
